Immigration lawyers, or doing it yourselves

Written by Alon, founder of IsraelVisa · Based on the procedures of the Population and Immigration Authority

Nothing in the procedures requires a couple to be represented. The application is filed online, both partners present the originals and attend the interviews in person, and the end of the process is conditioned on both attending. The procedures mention a representative once, as someone a request to complete documents may reach. So the Authority can write to someone acting for you, but no one can be interviewed in your place or create the evidence of a shared life that only you have.

Immigration lawyers in Israel work in a wider field: status for partners and family members of Israelis, work visas, citizenship and naturalisation, and appeals before the Appeals Tribunal and the courts. In the Gradual Process a lawyer's value is in reading a refusal for what it leaves unsaid, writing the internal appeal and the appeal to the Tribunal, asking for a stay of execution and appearing at the hearing under a power of attorney. That help is most often sought in the situations the procedures treat as exceptions: an earlier stay without status, a criminal record abroad, a partner still married to someone else, a second track such as asylum.

Many couples file alone, and the plain route fits them: a relationship that is easy to document, documents that can be obtained and authenticated, both partners in Israel lawfully, no earlier refusal. Others start alone and bring in a lawyer only if a question arises, or consult once on one point. Fees are agreed with the lawyer, best in writing, with fees and expenses listed separately, and never include the Authority's own fees. The choice is yours; this site gives no legal advice and represents no one before the Authority.

The articles below cover how to decide, what immigration lawyers do and how the profession is regulated, how to choose one, how fees are structured, and what a representative may and may not do before the Authority and the Tribunal.

Doing the Gradual Process yourselves or with a lawyer: how to decide

Frequently asked questions

Does the Authority require a lawyer?

No. No clause in the procedures requires representation. The application is filed online, and attendance at the interviews and at the end of the process is personal.

When does a lawyer add the most value?

After a refusal, when an internal appeal and an appeal to the Appeals Tribunal must be filed within short deadlines and in Hebrew, and in the situations the procedures treat as exceptions: an earlier stay without status, a criminal record, a partner still married to someone else, a second track.

What can a lawyer not do for us?

Be interviewed in your place, create the evidence of a shared life that only you have, or shorten the periods the procedures set.
