Doing the Gradual Process yourselves or with a lawyer: how to decide

The short answer

No clause in the procedures of the Population and Immigration Authority requires a couple to be represented. The Israeli partner, or both of you, file the application online, and every appearance the procedures require is personal. A lawyer is a choice, not a condition; in some situations it is the right choice, and this article says which, from procedures 5.2.0008, 5.2.0009 and 5.2.0011 and the Appeals Tribunal's instructions.

What the procedures say about representation

The words lawyer, counsel and power of attorney do not appear in the three procedures. They set who acts: both of you at the Israeli representation when you are abroad; the Israeli partner filing online when the foreign partner is still abroad; you or the Israeli partner filing online when you are both in Israel.

Attendance is personal at every stage: both of you present the originals and, where possible, are interviewed at the same appointment; the office may call either of you to an interview at any stage; and ending the process is conditioned on both partners attending in person. The procedure for spouses of permanent residents says it in a heading: personal attendance is mandatory.

A representative is mentioned once: the period for completing documents runs from the day the request reached the applicant or the applicant's representative. So the Authority can write to someone acting for you; no one can be interviewed in your place.

When managing it yourselves is realistic

The plain route fits many couples: a relationship that is easy to document, foreign documents that can be obtained and authenticated, both of you in Israel lawfully or the Israeli partner filing before the foreign partner arrives, no earlier stay without status, no criminal record, both free to marry. Organised self-management then means:

  • Working through the procedure's document list, including a status certificate from the last six months, a certificate of good conduct and evidence of a shared life for the last year.
  • Completing documents within the 45 days the procedure gives; otherwise the application is refused outright.
  • Applying online to renew each licence three months before it expires; after 180 days from expiry only a new application is possible.
  • Reporting every change in your circumstances, including a separation.
  • Keeping copies, application numbers and access to the email address you gave, where decisions are sent.
  • Preparing for the interview together, so that your answers match what you filed.

Situations in which legal help makes sense

Each of these is a rule in the procedures:

  • A refusal. It is given in writing with reasons and cancels a licence given under the process. An internal appeal is filed within 21 days of receiving the decision; an appeal to the Appeals Tribunal within 30 days of the decision, in Hebrew, with an affidavit and a fee.
  • An earlier stay without status, a removal, a refusal at the border or under another procedure: the head of the visa team decides on further checks and on refusal. After a court order to leave Israel that was not complied with, as a rule the application is handled only after departure, and a final judgment of that kind brings an outright refusal.
  • A criminal record abroad: the office asks for detailed information and the sentence from the country of origin; a person wanted or suspected of an offence also counts.
  • A security or nationality restriction: nationals of countries named by the security bodies fill in a CV form for a security check; nationals of Iran, Lebanon, Syria and Iraq are rejected outright under the Temporary Order.
  • A partner still married to someone else, in the shared-life procedure: genuine efforts to end the marriage must be shown, a B/1 licence outside the process may be given for up to a year to settle the status, and otherwise the application is refused.
  • A second track, such as a humanitarian A/5 licence, refugee status or a pending asylum application: the procedures keep some in force during the review and require a choice between others.

Application refused: what are the options

How to decide

What a lawyer does: reads a refusal for what it leaves unsaid, writes the internal appeal and the appeal to the Tribunal, asks for a stay of execution and appears at the hearing under a power of attorney. A lawyer cannot be interviewed in your place, cannot create the evidence of a shared life that only you have, and cannot shorten the periods the procedures set.

Four questions usually settle it. Complexity: does any situation above apply to you? Language: the appeal to the Tribunal is filed in Hebrew. Time: can one of you keep the file and its dates? Risk: a refusal cancels the licence, and a new application is normally possible only a year later.

The decision is not final: many couples start by themselves and bring in a lawyer only if a question arises, or consult once on one point.

If money is the obstacle, the Israel Bar's Schar Mitzvah scheme gives free legal advice in civil matters to people of limited means who are not entitled to state legal aid, subject to its own tests and case by case. An appeal to the Tribunal can be filed with a request for exemption from the fee.

Frequently asked questions about the Gradual Process

Frequently asked questions

Do we need a lawyer to file the application?

No. The procedures place the online application with the Israeli partner, or with both of you, and say nothing about representation. A lawyer is an option, not a requirement.

Can a lawyer attend the interview instead of us?

No. The procedures require both partners in person to present the originals, at the interview and at the end of the process. The only mention of a representative is that a request to complete documents may be delivered to one.

Our application was refused. Is this the moment to turn to a lawyer?

This is the clearest case. An internal appeal is filed within 21 days of receiving the decision and an appeal to the Appeals Tribunal within 30 days of the decision, in Hebrew, with an affidavit and a fee. Reading the reasons and choosing the route is legal work.

Is there free legal help?

The Israel Bar's Schar Mitzvah scheme gives free advice to people of limited means who are not entitled to state legal aid, subject to its tests and with each request examined on its own. Before the Appeals Tribunal, a request for exemption from the fee can be filed with the appeal.
