What immigration lawyers in Israel do, and how the profession is regulated

The short answer
An immigration lawyer in Israel is a member of the Israel Bar whose practice includes entry, residence and citizenship matters. The title describes experience, not a separate licence: Israeli law has no recognised specialisations. The partner process is one case type among several, each with its own law or procedure. Whether your own application needs one is answered in the article linked below.
Doing the Gradual Process yourselves or with a lawyer: how to decide
The case types and the law behind each
- Status for the partner of an Israeli: procedures 5.2.0008 (married to a citizen), 5.2.0009 (shared life, including same-sex couples) and 5.2.0011 (married to a permanent resident), under the Entry into Israel Law and the Citizenship Law; the Gradual Process of the overview below.
- Citizenship: naturalisation under the Citizenship Law, which lets the Minister waive conditions for a special reason and naturalise the spouse of a citizen without meeting all of them, and immigration under the Law of Return for a Jew and the child, grandchild and spouse of a Jew.
- Work visas: the Foreign Workers Law requires an employment permit for the employer and a B/1 work visa for the worker.
- Humanitarian status: under procedure 5.2.0022 a foreigner with special humanitarian grounds who fits no other procedure applies to the inter-ministerial committee, which advises the Director General of the Authority, who decides.
- Asylum: the Authority's procedure 5.2.0012 for applicants for political asylum.
- Detention: a detainee is brought before the Detention Review Tribunal within 96 hours, may be released on bail and may be represented before it free of charge by a non-lawyer.
Appeals and courts
A refusal opens three routes, and much of a lawyer's work is here. First, the internal appeal under procedure 1.6.0001, named in the refusal notice; procedure 5.2.0022 gives 21 days from receipt of the decision for it.
Second, the Appeals Tribunal under section 13(24) of the Entry into Israel Law, for the Authority's decisions on entry, stay, departure and citizenship. The appeal is filed within 30 days of the decision, in Hebrew, with an affidavit and a fee of NIS 755 per the Tribunal's instruction sheet of 1 January 2026, or with a request for exemption from the fee.
Third, the Administrative Affairs Court: a final decision of the Tribunal may be appealed to it as of right within 45 days, and decisions under those laws that the Tribunal does not hear go to it directly under the Administrative Courts Law.
Who may practise
The Bar Association Law of 1961 reserves four kinds of act to Bar members when done as an occupation or for pay: representing another person before courts, tribunals and quasi-judicial bodies; representing another person before the offices the Law lists; drafting documents of a legal character; and legal advice and opinions. Membership comes after a recognised law degree, a 12-month internship, the Bar examinations and admission.
A non-lawyer who performs a reserved act commits an offence, holding oneself out as a lawyer carries up to a year's imprisonment, and a court will not hear a non-lawyer's fee claim for reserved work.
The Authority is not among the offices the Law lists, and the partner procedures have the couple acting alone; advice on your file, drafting an appeal and appearing before the Tribunal or the court are reserved acts.
Why "immigration lawyer" is a description, not a licence
The Law defines only lawyer and foreign lawyer; it has no specialisation titles. The Bar's advertising rules let a lawyer state the fields of practice of the lawyer and the office, and forbid an advertisement that may mislead the public; they say nothing about the words expert or specialist. A lawyer who advertises immigration law is telling you what the office works on, not showing a certificate; the useful questions are about experience with the case types above.
How to check a licence
The Israel Bar keeps a public lawyer search on its website, with filters by city and for notaries, arbitrators and lawyers authorised for enduring powers of attorney. It also publishes a separate list of suspended and expelled lawyers, who may not perform any reserved act; the Bar notes that the list is updated by hand and is not guaranteed to be complete, and refers full checks to the secretariat of its disciplinary court.
Where legal aid exists, and where it does not
State legal aid under the Legal Aid Law goes to a person who cannot afford a lawyer, in the matters set by regulation and after a means test. In immigration the documented cases are narrow: a victim of trafficking or slavery is represented in proceedings under the Entry into Israel Law without a means test, and foreign minors are represented before the Detention Review Tribunal. The published list also names claims under the Law of Return, the Citizenship Law and the Population Registry Law.
The partner process and an appeal to the Appeals Tribunal are not on that list. For a couple of limited means, the options in the article on doing the process yourselves remain.
How IsraelVisa helps
IsraelVisa helps you keep the documents, the evidence of your shared life and the dates of your file in one place, yourselves and at your own pace, so that any lawyer you consult starts from an orderly file. IsraelVisa does not give legal advice; if you want a lawyer, you can find independent lawyers through it.
Frequently asked questions
Is "immigration lawyer" a recognised specialisation in Israel?
No. The Bar Association Law defines only lawyer and foreign lawyer and has no specialisation titles. The advertising rules allow a lawyer to state fields of practice; the words describe experience, which you may ask about.
Can a consultant who is not a lawyer handle our file for a fee?
Legal advice, drafting legal documents and appearing before the Tribunal or a court are reserved to Bar members. Doing them for pay without a licence is an offence, and a court will not enforce a fee claim for such work. Check any name in the Bar's public search before paying.
Does state legal aid cover the Gradual Process?
The schedule to the Legal Aid Law and the published list of services do not include the partner process or an appeal to the Appeals Tribunal. The documented immigration cases are trafficking victims and foreign minors before the Detention Review Tribunal.
Which body hears an appeal against a refusal of our application?
After the internal appeal under procedure 1.6.0001, the Appeals Tribunal under section 13(24) of the Entry into Israel Law, within 30 days of the decision. Its final decision may be appealed to the Administrative Affairs Court within 45 days.
