Choosing a lawyer for the Gradual Process: checks, questions and warning signs

The short answer

The Gradual Process does not require a lawyer; whether to use one is covered in a separate article, linked below. This article starts after that decision: how to check a lawyer, what to ask at the first meeting and which signs should make you pause. Every check rests on the Bar Association Law of 1961, the Israel Bar's rules and lists, or the Population and Immigration Authority's procedures.

Doing the Gradual Process yourselves or with a lawyer: how to decide

Check the licence first

Only a member of the Israel Bar may, for pay, represent you before a tribunal, draft legal documents for you or give you legal advice. A non-lawyer who does so commits an offence, and a court will not enforce a fee claim for such work.

Two checks take minutes: the Bar's public lawyer search, and the Bar's list of suspended and expelled lawyers, who may not perform any act reserved to lawyers. The Bar says that list is updated by hand and not guaranteed complete, and refers full checks to the secretariat of the disciplinary court by email. A foreign lawyer registered in Israel must state that status, and the country of the licence, on letterhead and working documents.

Experience, not a title

Israeli law has no specialisation titles: the Bar Association Law defines only "lawyer" and "foreign lawyer", and the Bar's advertising rules allow a lawyer to state fields of practice, nothing more. "Immigration lawyer" describes what an office does, not a qualification the Bar has examined. So ask concretely:

  • Files handled under procedure 5.2.0008 (spouses of citizens) and 5.2.0009 (shared life, including same-sex couples), or 5.2.0011 if your partner is a permanent resident.
  • Appeals before the Appeals Tribunal under the Entry into Israel Law: filed within 30 days of the decision, in Hebrew, with an affidavit, a fee and a power of attorney.
  • Familiarity with the current editions: 5.2.0008 of 20.07.2026 and 5.2.0009 of 16.07.2026.

Questions for the first meeting

  • Who in the office handles the file, and who answers when you write.
  • What the lawyer does: correspondence with the Authority, requests to complete documents (the procedures let such a request be served on your counsel), and the appeals after a refusal.
  • What stays yours: the interviews. The office may summon the applicants, or either of them, at any stage; the couple is interviewed when the originals are presented and both spouses before every extension. No clause lets a representative be interviewed for you.
  • Also yours: the documents, and the evidence of a sincere relationship and a shared centre of life over the last year.
  • The scope, in writing. The Bar's ethics rules require a limitation of the scope to be written; ask for the whole scope that way.

What a fee quote must separate

Section 85 of the Bar Association Law forbids a lawyer from taking one combined sum for fees and expenses without distinguishing between them and itemising the expenses. A quote should show the fee, the expected expenses and VAT, which is 18 % since 1 January 2025. The Authority's own fees are yours, not the lawyer's: the procedures make the application subject to the Authority's fee schedule, and a new fee is due if a closed application is reopened.

A fee that depends on the result is allowed in a civil matter; if it appears excessive, the Bar may, at your request, set a suitable fee, and an overpayment can be reclaimed.

Warning signs the rules point to

  • A promised outcome. The procedures leave the office discretion at every step; no one can guarantee a result or shorten their periods.
  • A person who is not a licensed lawyer offering to "handle the file" for a fee: an offence, and no fee can be claimed for it.
  • One total price with no split between fee and expenses, which section 85 forbids.
  • Pressure to sign at the first meeting without a written scope.
  • A "certified specialist" in immigration: the Bar issues no such certificate.
  • An offer that someone else will attend your interview.

If something goes wrong

A complaint against a lawyer goes, as a rule, to the district ethics committee of the district where the lawyer's office is, on the Bar's complaint form, in three copies, by mail or fax, with an affidavit signed before a lawyer; a complaint not on the form or missing details is shelved. The committee obtains the lawyer's written response and decides whether to bring a disciplinary charge. If it shelves the complaint, section 63 of the Law lets you ask the national ethics committee to re-examine it.

Disciplinary penalties range from a warning to a fine, suspension for up to ten years and expulsion. A dispute about the amount of a fee is a civil matter.

How IsraelVisa helps

Whichever way you go, the documents, the evidence of your shared life and the dates remain yours. IsraelVisa helps you keep them in one place, at your own pace, so that a lawyer, if you choose one, starts from an orderly file. IsraelVisa does not give legal advice and does not recommend any lawyer; if you wish, you can find independent lawyers through it.

Frequently asked questions

How do we know the person is really a lawyer?

Look the name up in the Israel Bar's public lawyer search and check the Bar's list of suspended and expelled lawyers. The Bar says that list is not guaranteed to be complete; the secretariat of the disciplinary court answers full checks by email.

Is there an official "immigration law specialist"?

No. The Bar Association Law defines only lawyer and foreign lawyer, and the advertising rules allow a lawyer to state fields of practice. Ask about files under procedures 5.2.0008 and 5.2.0009 and before the Appeals Tribunal instead.

Does the lawyer's fee include the Authority's fees?

No. The procedures make the application subject to the Authority's own fee schedule, and that is paid by you. A quote must separate the lawyer's fee from expenses, and VAT is 18 %.

Can the lawyer go to the interview for us?

No. The procedures summon the applicants themselves, interview the couple when the originals are presented and both spouses before every extension. A lawyer can correspond with the Authority and file appeals, not be interviewed in your place.

Where do we complain about a lawyer?

To the district ethics committee of the Bar for the lawyer's district, on the complaint form with an affidavit. If the complaint is shelved, section 63 of the Bar Association Law lets you ask the national ethics committee to re-examine it.
