Applying as a partner while holding another licence

The short answer

Many foreign partners reach the Gradual Process from somewhere else: a tourist licence, a caregiver's B/1 licence, a humanitarian A/5 licence, or an open asylum application. Procedures 5.2.0008 (spouses of citizens, edition 16, 20.07.2026) and 5.2.0009 (shared life and same-sex couples, edition 17, 16.07.2026) answer three questions: can two tracks run at once, what happens to a licence held on the day you apply, and how the asylum route works. Where the texts are silent, this article says so.

One track at a time, with exceptions

Both procedures set the same rule: a foreign partner who has filed another application for status under a different procedure is asked to choose one track, in a detailed letter saying which application goes on; the second is closed. No choice is needed, and both applications may run in parallel, when the other one is:

  • An application not under the Entry into Israel Law.
  • An asylum application under procedure 5.2.0012.
  • An application for aliyah on the basis of conversion, or for status under the Law of Return (procedure 5.2.0001).
  • An application under section 9 of the Citizenship and Entry into Israel Law (Temporary Order), 2022.

A licence held on the day you apply

  • A B/2 tourist licence: under 5.2.0009 it can be extended until the checks end. Procedure 5.2.0008 has no tourist clause; once all the documents are in and nothing else bars it, a general B/1 licence may be given for up to six months for the remaining checks.
  • A caregiver's B/1 licence: the office asks for a letter from the employer confirming that the employer knows of the application for status and wishes to keep employing the foreign partner.
  • An A/5 licence on humanitarian grounds, under a court ruling or a government decision, or as a recognised refugee: the foreign partner keeps it, and it can be extended until the decision. If the application is approved, the partner holds an A/5 as a spouse, and the periods set for the B/1 and A/5 stages still apply.
  • A B/1 or A/5 licence from an earlier Gradual Process with a former partner: it is cancelled under procedure 5.2.0017, a B/1 is given until the checks end, and an approved application starts a new Gradual Process.
  • An accompanying minor receives an A/2 licence for up to six months.

None of these periods counts in the Gradual Process. Neither procedure names a student's A/2 licence, a B/1 in another sector or a working-holiday licence; in that case, ask the office before the licence runs out. With any licence, a partner who travels while the application is pending needs a re-entry visa first, or the licence lapses.

The asylum route

When the asylum application came first and is undecided, chapter E.3 applies. The partner submits the documents available; handling starts without the rest. If the official finds a sincere relationship, a shared centre of life and no impediment, the Gradual Process starts with a B/1 licence.

  • The B/1 can be renewed for up to 63 months in a row. Before each renewal the office checks sincerity, centre of life, that the asylum application is still current, and that there is no criminal or security impediment.
  • After 63 months the regional director may upgrade to an A/5, if asylum is still undecided and the conditions are met. The A/5 is then extended two years at a time, on the same checks, while asylum is undecided. No further step is possible until the full documents are produced or asylum is decided.
  • An asylum application filed after the partner application needs a letter explaining the delay, with evidence. If the reasons are justified, the regional director may waive the missing documents; if not, the partner has six months to produce them, the licence extended under procedure 5.2.0012 meanwhile.
  • A partner whose application is refused while asylum is open is not required to leave; the asylum unit continues.
  • Once asylum is decided: after a rejection, the documents must be completed within 45 days on a B/1 outside the Gradual Process (the head of the visa team may extend this to 12 months in all); after recognition as a refugee, the application continues on the A/5 without a document demand.

Working in Israel during the Gradual Process

A relationship that began after the licence expired

When the foreign partner is in Israel without a valid licence and no court has ordered departure, both partners are interviewed. If the relationship seems sincere at first sight, departure is not required until the decision, provided the full application was filed before enforcement steps began. If it seems fictitious, or began after the licence expired, the foreign partner is required to leave.

A partner who stayed despite a court order to leave has the application handled only after leaving, unless the regional director allows it in a very exceptional, documented case.

Who decides

  • The office official: the start of the Gradual Process, and a re-entry visa.
  • The head of the visa team: refusals, and a six-month extension of the previous licence where sincerity is in doubt.
  • The regional director: the A/5 upgrade after 63 months, a waiver of documents, and handling despite a court order.
  • The office director: a new application within a year of a refusal, on a clear change of circumstances.

How IsraelVisa helps

IsraelVisa helps you record which licence the foreign partner holds and when it expires, keep the employer's letter or asylum papers with the evidence of your shared life, and follow each renewal date, yourselves and at your own pace. Frequently asked questions

My partner has an asylum application open. Must we close it to apply as partners?

No. An asylum application under procedure 5.2.0012 is one of the exceptions to the one-track rule; both can run in parallel, and chapter E.3 sets the route for that case.

My partner works as a caregiver on a B/1 licence. What changes when we apply?

The office asks for a letter from the employer confirming that the employer knows an application for status was filed and wishes to keep employing your partner. The time on that licence is not counted in the Gradual Process.

Can a tourist licence be extended while the application is checked?

Under procedure 5.2.0009 a valid B/2 licence can be extended until the checks end. Under procedure 5.2.0008, once all the documents are in, a general B/1 licence may be given for up to six months instead.

Does the procedure say anything about a student or working-holiday licence?

No. Neither 5.2.0008 nor 5.2.0009 names those licences. Ask the office how your licence will be treated before it runs out.
